The New York State Workers’ Compensation Law was passed by the Legislature in 1914 as a compromise between employees and employers. Employees gave up the right to sue employers for negligence resulting in an injury in exchange for workers’ compensation benefits without regard to fault, so as long as the injury was work related. Each employer in the state, with a few certain exceptions, is required to provide workers’ compensation insurance coverage for their employees. Since the passing of the Workers’ Compensation Statute the administration has eradicated barriers making obtaining benefits more difficult for the injured worker.
