Can I get workers’ compensation for a back injury?

On Behalf of | Sep 8, 2023 | Workers' Compensation

Back injuries can happen in any type of job. Most people associate back injuries with jobs involving physical labor, but back injuries can happen in office jobs that require a lot of sitting, as well.

Sometimes a back injury happens because of a one-time event, such as a fall, or bending while trying to pick up or move heavy items. A back injury can also happen from sitting too long in one position, such as while driving, or sitting in a poorly designed chair and reaching over to type or use a telephone.

What you must show

When your back injury gets bad enough that it prevents you from doing your job, you could receive workers’ compensation benefits during the time you are out of work. New York employers are generally required to obtain workers’ compensation insurance for their employees.

Whether you qualify for workers’ compensation benefits for a back injury depends on many different factors. You must show that your job caused the injury and that it occurred during the course of your employment.

Gathering your evidence

Additionally, you must present evidence showing that your injury prevents you from doing your job. Evidence can include medical documents or a doctor’s testimony. Keep all medical records relating to your injury since you may need some of them to prove your case.

It is important to follow your doctor’s instructions and keep all your medical appointments. To qualify for workers’ compensation benefits, you must show that you are following all required instructions from your doctor and participating in all treatment.

Tell your employer about your injury right away

Your employer has a legal duty to provide you with a safe and healthy working environment.

When you sustain a back injury at work or due to your working conditions, notify your employer immediately, since the law requires you to notify them about the injury within 30 days.

After that, you can begin the process of filing a workers’ compensation claim.
